Why AP High Court in Telangana – Joint Capital Status in Question

Two landmark judgements of High Court of Judicature at Hyderabad for Telangana and Andhra Pradesh states are likely to impact the administration of Andhra Pradesh Government to a greater extent. The nature of joint capital status for Hyderabad as given in AP Reorganisation Act 2014 has been tilting towards favouring Telangana state as the progress of the time.

The High Court at Hyderabad (Joint High Court) has out-rightly dismissed the plans of setting up AP High Court in Hyderabad, which is a territory of Telangana State. The Court also lauded the generosity of the Telangana state in offering land and facilities for setting up separate AP High Court in Hyderabad.

In another judgement, The Joint High Court has declared that the bank accounts which were managed by APSCHE should be transferred to Telangana Council for Higher Education as it has powers to administer services as per the AP Reorganisation Act 2014.

Both the judgements are a jolt to Andhra Pradesh Government. It is inevitable for AP to set up High Court in Amaravathi or some other place. The judgements have once again proved that the powers over Hyderabad and institutions in Hyderabad remain with Telangana State and AP has to get services from Telangana for the period of joint capital status to Hyderabad.
